Terms & Conditions of Sale
These Terms & Conditions of Sale (“Terms”) govern all contracts for the supply of goods by Rival Ltd, trading as Rival Performance, to the customer. By placing an order via our website, you agree to be bound by these Terms in their entirety. Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or any other applicable UK consumer protection legislation.

Rival Ltd operates in accordance with the laws of England and Wales. All contracts shall be governed by and construed in accordance with those laws.
2. Interpretation
In these Terms, “we”, “us”, and “our” refer to Rival Performance (Rival Ltd). “You”, “your”, and “the customer” refer to the purchaser of goods. “Goods” means all items supplied by us to you pursuant to any order placed through our website or by other means.
3. Basis of Contract
A contract for the sale of goods is formed only when we issue written or electronic confirmation of acceptance of your order. We reserve the right to refuse or cancel any order at our sole discretion prior to dispatch.
All goods are sold subject to these Terms, which override any inconsistent terms proposed by the customer unless expressly agreed in writing by a director of Rival Ltd. No variation or cancellation of these Terms is valid unless confirmed in writing by Rival Performance.
4. Product Descriptions & Pricing
All product descriptions, specifications, compatibility data, and images are provided in good faith for guidance only. Information is often supplied by manufacturers and may change without notice.
While we strive for accuracy, we do not warrant that descriptions, prices, or specifications are error-free. In the event of a pricing or listing error, we reserve the right to amend or cancel the order. If payment has been made, a full refund or credit note will be issued.
Images are for illustrative purposes only and may differ from the actual product supplied. All prices are shown in GBP (£) and include VAT at the prevailing rate unless otherwise stated.
Prices may be amended at any time without notice. Orders placed prior to a price change will be honoured at the agreed price once full payment is received.
Rival Performance shall not be liable for any loss arising from typographical or pricing errors, provided such errors are corrected as soon as reasonably practicable.
5. Customer Responsibility & Fitment
It is the customer’s sole responsibility to ensure that goods purchased are suitable and correctly specified for their vehicle or intended purpose. We accept no liability for losses arising from incorrect fitment, incompatibility, or misuse.
Customers must check all goods for compatibility prior to installation. Once goods are installed, modified, or used, they are deemed accepted and no return or refund shall be permitted.
Where fitment advice is provided, such information is given in good faith based on manufacturer data. Rival Performance accepts no responsibility for fitment errors unless a written guarantee of compatibility has been expressly issued by a company director.
Verbal, telephone, or social media advice shall not constitute binding fitment confirmation unless subsequently confirmed in writing.
We shall not be liable for any labour, fitting, removal, or diagnostic costs under any circumstances.
6. Made-to-Order, Custom & Special-Order Goods
Goods that are custom-made, bespoke, made-to-order, or ordered specifically from a manufacturer or supplier on your behalf are exempt from cancellation and return once processing has commenced.
Such goods include, but are not limited to: colour-customised brake lines, special-finish brake discs, non-stock suspension kits, colour-coded components, personalised items, or any product manufactured or ordered specifically for your vehicle.
These goods are non-returnable and non-refundable unless found to be defective or supplied in error in breach of Section 9 of the Consumer Rights Act 2015 (satisfactory quality, fitness for purpose, and description).
7. Returns & Refunds
Standard stocked goods may be returned within fourteen (14) days of delivery provided they are unused, unfitted, and in their original packaging, in accordance with the Consumer Contracts Regulations 2013.
Returns must be authorised in writing by Rival Performance before goods are sent back. Unauthorised returns may be refused.
All refunds are normally issued to the original payment method for consumer purchases unless otherwise agreed in writing by Rival Performance. We reserve the right to apply a restocking charge of up to twenty percent (20%) of the goods’ value to cover administrative and handling costs on non-faulty returns.
Delivery and return shipping costs are non-refundable, except where goods are defective or not as described under the Consumer Rights Act 2015.
Goods showing any sign of installation, use, modification, or damage will be rejected and returned to the customer at their expense.
8. Cancellations
Orders may be cancelled only if they have not yet entered processing, which includes any stage of order preparation, stock allocation, supplier ordering, or packaging. Once an order has entered processing in any form, it is considered committed and cannot be cancelled, regardless of whether the website or order status has been updated.
Custom, made-to-order, and special-order items are non-cancellable once supplier processing or production has started.
Cancellation requests received within twenty-four (24) hours of placing an order may be approved only if processing has not begun. After this period, administrative or supplier handling fees may be deducted from any refund.
Rival Performance reserves the right to cancel any order at its discretion, including (but not limited to) stock shortages, pricing discrepancies, or suspected fraudulent activity. Where Rival Performance initiates a cancellation, a full refund or credit note will be issued.
9. Delivery & Risk
Delivery times are estimates only. Rival Performance shall not be liable for delays caused by couriers, suppliers, or events beyond our reasonable control. Estimated delivery dates are not guaranteed. Cancellation due to supplier or courier delay is not permitted once goods have been ordered or dispatched.
All deliveries are tracked and may require a signature. Where tracking confirms delivery to the address provided, the order shall be deemed fulfilled.
Risk passes to the customer once goods are delivered to the address provided or collected by the courier on the customer’s behalf. Title to the goods shall not pass until full payment has been received and cleared.
If goods are lost or damaged in transit, you must notify us in writing within twenty-four (24) hours of receipt or expected delivery. Claims made after this period may not be accepted.
Where goods are reported missing or damaged, an investigation will be raised with the courier. Replacement or refund will be issued only once the courier confirms the outcome of the claim.
10. Warranty
All goods are supplied with the manufacturer’s warranty, where applicable, and are subject to the terms and limitations of that warranty. Rival Performance facilitates warranty claims between customers and manufacturers but does not provide a separate warranty beyond that offered by the manufacturer or supplier.
Warranty claims must be accompanied by proof of purchase and, where relevant, evidence of professional installation.
Warranty does not cover wear and tear, misuse, neglect, improper installation, unauthorised modification, or use in competition environments.
Warranty is void where goods have been modified, altered, or used in conjunction with aftermarket systems not approved by the manufacturer.
Our liability in respect of any warranty claim shall be limited, at our option, to repair, replacement, or issue of a credit note for the goods in question. Labour, fitting, removal, or consequential costs are expressly excluded.
11. Limitation of Liability
To the fullest extent permitted by law, Rival Performance shall not be liable for any indirect, incidental, or consequential losses, including but not limited to loss of profit, revenue, or business opportunity, or any costs relating to labour, fitting, or vehicle downtime.
Our total liability in respect of any claim shall not exceed the total contract price of the goods supplied.
Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation.
12. Force Majeure
We shall not be in breach of contract or liable for any delay or failure to perform our obligations where such delay or failure results from events, circumstances, or causes beyond our reasonable control, including but not limited to acts of God, strikes, supplier delays, or courier disruptions.
13. Chargebacks & Payment Disputes
Initiating a payment dispute or chargeback without first contacting Rival Performance in writing to resolve the matter may constitute a breach of contract. Rival Performance reserves the right to recover all administrative, banking, or legal costs incurred as a result of unjustified payment disputes.
14. Business Purchases
Where goods are purchased by a business, trade buyer, or for commercial use, statutory consumer rights under the Consumer Rights Act 2015 shall not apply. All such sales are governed exclusively by these Terms, and liability shall be limited to the value of the goods supplied.
15. Data Protection
We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Full details of how your data is handled are provided in our Privacy Policy.
16. Intellectual Property
All website content, imagery, design, text, and branding are the intellectual property of Rival Performance. Unauthorised reproduction, adaptation, or distribution is strictly prohibited.
17. Governing Law & Jurisdiction
These Terms and all contracts arising hereunder shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over all disputes arising under or in connection with these Terms.
18. Severability
If any provision of these Terms is held to be invalid, unlawful, or unenforceable, such provision shall be severed from the remaining clauses, which shall remain valid and enforceable to the fullest extent permitted by law.
19. Entire Agreement
These Terms constitute the entire agreement between Rival Performance and the customer and supersede all prior representations, understandings, or communications relating to the sale of goods.
